How long does a civil lawsuit take in Ontario?

It depends on the complexity of the dispute and the court's schedule. Many commercial disputes settle within months through negotiation or mediation; matters that proceed to trial in the Superior Court of Justice can take considerably longer. We assess realistic timelines with you at the outset and pursue early resolution wherever it serves your interests.

Do I have to go to court to resolve my dispute?

Not necessarily. Most civil and commercial disputes resolve without a trial, through demand letters, negotiation, mediation, or arbitration. We prepare every file as if it will be tried, which typically strengthens your position in settlement discussions.

Is there a deadline to start a claim?

Yes. In Ontario, most civil claims are subject to a basic two-year limitation period from the date the claim was discovered, and some matters have shorter notice periods. If you believe you have a claim, speak with a lawyer promptly so your rights are preserved.

What is the small claims court limit in Ontario?

As of October 2025, the Ontario Small Claims Court can hear claims up to $50,000, raised from the previous $35,000 limit. Claims above that amount, or matters seeking non-monetary relief such as an injunction, generally proceed in the Superior Court of Justice. As a full-service litigation firm, we act in both courts and can advise which one is right for your claim.
