Common Questions

My application was refused. What are my options?

Depending on the file, you may request reconsideration, reapply with a stronger record, or seek judicial review at the Federal Court. Judicial review has strict deadlines: generally 15 days for decisions made inside Canada and 60 days for decisions made outside Canada. Act quickly.

What is a procedural fairness letter?

It is a notice that an officer has concerns, often about misrepresentation or eligibility, and intends to refuse your application unless you respond convincingly. Your response is frequently the last chance to save the application, and it should be prepared with legal advice.

Can anything be done about a file that has been in processing for years?

Often, yes. Where a delay is unreasonable, a mandamus application at the Federal Court can compel the government to make a decision. We assess the timeline, demand action, and litigate when necessary.
